State mini-TCPAs: Oklahoma OTSA takes effect; Florida narrows FTSA in 2023
The Oklahoma Telephone Solicitation Act took effect Nov 1, 2022, requiring prior express written consent for automated sales calls. Florida amended its FTSA again in 2023 (ch. 2023-150), narrowing the autodialer definition and adding a text safe harbor: the consumer must reply STOP and the seller gets 15 days to stop before a suit. Florida also caps solicitation calls at 3 per 24 hours on the same subject, 8 a.m.–8 p.m.

What changed
States can be stricter than the federal TCPA. The Oklahoma Telephone Solicitation Act took effect November 1, 2022 and requires prior express written consent for automated sales calls. Florida amended its FTSA in 2023 (ch. 2023-150): it narrowed the autodialer definition and added a text safe harbor, under which the consumer must reply STOP and the seller gets 15 days before a suit can be filed.
Florida also limits solicitation calls to 3 per 24 hours on the same subject, between 8 a.m. and 8 p.m.
What it means for pay-per-call teams
